Terms of Service

Effective date: April 26, 2026

1. Acceptance

These Terms of Service ("Terms") form a binding agreement between you and OKO Labs Inc. ("OKO Labs", "we", "us", or "our"), the operator of the WhichFrat mobile application and the website at whichfrat.com (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

  • You must be at least 13 years of age to use the Service. Users under 18 must have a parent or guardian's permission.
  • You must be a current student or staff member at an accredited college or university with a valid .edu email address, or be invited as a chapter officer via a valid join code.
  • By creating an account, you represent that you meet these requirements and that the information you provide is accurate.

3. Subscriptions and Billing

  • PNM (student) accounts are free, forever. No subscription, no card on file.
  • Chapters may subscribe to paid tiers (Basic, Pro) for CRM, analytics, and roster features. The Free chapter tier supports up to 10 active CRM candidates at no cost.
  • Paid chapter tiers include a 14-day free trial. After the trial, your subscription auto-renews monthly until cancelled.
  • Subscriptions are billed monthly based on monthly active users (MAU), capped at $500 per chapter per month.
  • Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms.
  • No refunds are issued except where required by law. Cancel any time from the Billing screen; access continues through the end of the paid period.
  • We may change pricing with 30 days' notice. Continued use after the change constitutes acceptance of the new pricing.

4. User Conduct

You agree not to:

  • Use the Service for any illegal or unauthorized purpose.
  • Harass, bully, intimidate, threaten, or dox other users.
  • Post false, misleading, or deceptive content about yourself or your chapter.
  • Manipulate match scores, interest signals, or CRM data through automated or fraudulent means.
  • Attempt to access other users' private data, including other PNMs' values profiles or other chapters' candidate records.
  • Discriminate against users based on race, color, religion, sex, sexual orientation, gender identity, national origin, disability, or any other protected characteristic.
  • Scrape, crawl, or use automated systems to access the Service without permission.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Use another person's .edu email address or impersonate another user.
  • Interfere with or disrupt the Service or the servers and networks connected to it.

5. Content and Intellectual Property

You retain ownership of content you post (transparency posts, messages, chapter descriptions, photos). By posting, you grant OKO Labs a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content as needed to operate the Service.

You are solely responsible for content you post. Content must not violate any law, infringe third-party rights, or contain hate speech, sexual content involving minors, or personal attacks. We may remove content that violates these Terms without notice.

The Service itself — including its design, the value-alignment algorithm, the CRM workflow, and the WhichFrat name and brand — is owned by OKO Labs Inc. and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

6. Disclaimers

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
  • WhichFrat is not a recruitment guarantee. Match scores are algorithmic recommendations, not predictions of bid outcomes. Chapters make their own recruitment decisions.
  • WhichFrat is independent. We are not affiliated with, endorsed by, or sponsored by any university, fraternity, sorority, NIC, NPC, NPHC, MGC, IFC, or other Greek organization. Chapter relationships with their national organization and host university are at-will and outside our control.
  • We do not guarantee the accuracy of information provided by chapters or users, and we are not responsible for offline interactions between PNMs and chapters.

7. Limitation of Liability

To the maximum extent permitted by law, OKO Labs Inc. and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service — including but not limited to recruitment outcomes, chapter decisions, emotional distress, lost opportunities, or data loss. Our total cumulative liability for any claim arising from these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100).

8. Indemnity

You agree to indemnify and hold harmless OKO Labs Inc. and its officers, employees, and contractors from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

9. Termination

  • You may delete your account at any time from the app's Settings screen.
  • We may suspend or terminate your account for violation of these Terms, with or without notice.
  • Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 7, 8, and 10 survive termination.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Florida. Each party waives the right to a jury trial and to participate in a class action. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction for misuse of intellectual property or confidential information.

11. Changes to These Terms

We may modify these Terms at any time. We will post the updated Terms with a new effective date and, for material changes, notify you in-app or by email. Continued use of the Service after the effective date constitutes acceptance. If you disagree, stop using the Service and delete your account.
